1. ACCEPTANCE OF TERMS

By accessing our website (nccabinrentals.com) or booking a vacation rental property managed by NC Cabin Rentals, LLC (NCREC License #C41500), you agree to be bound by these Terms of Service (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

2. COMPLIANCE WITH NORTH CAROLINA LAW

These Terms are governed by the North Carolina Vacation Rental Act (N.C. Gen. Stat. § 42A) and all applicable North Carolina Real Estate Commission (NCREC) regulations. Our services and properties comply with all state and local regulations regarding vacation rental properties.

3. ELIGIBILITY AND BOOKING REQUIREMENTS

Age Requirements

  • You must be at least 25 years of age to make a reservation
  • The person making the reservation must be present during the entire stay
  • Valid government-issued photo identification is required at check-in

Booking Authority

By making a reservation, you represent and warrant that:

  • You are legally authorized to enter into this agreement
  • You are booking for lawful purposes only
  • All information provided is true, accurate, and complete
  • You accept financial responsibility for all charges incurred

4. RESERVATION AND PAYMENT TERMS

Rates and Fees

Total reservation costs include:

  • Nightly rental rate
  • Cleaning fees
  • North Carolina state and local taxes
  • Applicable service fees
  • Security deposit (refundable, subject to terms below)
  • Any additional fees disclosed at booking

Payment Schedule

  • Initial Payment: Due at time of booking (amount varies by booking platform)
  • Final Payment: Due 30 days prior to arrival for direct bookings
  • Accepted Payment Methods: Major credit cards, debit cards, and authorized third-party payment processors

Cancellation Policy

Direct Bookings:

  • 30+ days before arrival: Full refund minus processing fee
  • 14-29 days before arrival: 50% refund of rental amount
  • Less than 14 days before arrival: No refund
  • Travel insurance is strongly recommended
 

Platform Bookings:
Cancellations through Airbnb, VRBO, or Booking.com are subject to the platform’s cancellation policy selected at booking.

5. SECURITY DEPOSIT

Deposit Requirements

In accordance with N.C. Gen. Stat. § 42A-17:

  • Security deposits are held to cover potential damages, excessive cleaning, or violations of these Terms
  • Deposit amount varies by property and is disclosed at booking
  • Deposits are processed 7 days prior to arrival

Deposit Return

  • Deposits are returned within 45 days after checkout, as permitted by NC law
  • Deductions may be made for:
    • Damages beyond normal wear and tear
    • Missing items
    • Excessive cleaning requirements
    • Smoking violations
    • Unauthorized pets
    • Violations of occupancy limits

6. CHECK-IN AND CHECK-OUT

Check-In

  • Standard check-in time: 4:00 PM EST
  • Late check-in may be available with prior arrangement
  • Guest must provide estimated arrival time 24 hours in advance

Check-Out

  • Standard check-out time: 10:00 AM EST
  • Late check-out subject to availability and additional fees
  • Property must be left in the condition found, normal wear excepted

7. OCCUPANCY LIMITS AND USE RESTRICTIONS

Maximum Occupancy

  • Each property has a stated maximum occupancy that must not be exceeded
  • Occupancy includes all persons regardless of age
  • Violations will result in immediate eviction without refund

Prohibited Uses

The following are strictly prohibited:

  • Commercial photography or filming without written consent
  • Parties, events, or gatherings exceeding registered guests
  • Illegal activities of any kind
  • Smoking or vaping inside any property
  • Unauthorized pets (pet-friendly properties require approval and fees)
  • Subletting or unauthorized transfer of reservation
  • Excessive noise during quiet hours (10 PM – 8 AM)

8. PROPERTY RULES AND GUEST RESPONSIBILITIES

Guest Obligations

Guests agree to:

  • Treat the property with care and respect
  • Report any damages or issues immediately
  • Follow all property-specific rules provided at check-in
  • Properly dispose of trash and recycling
  • Secure property when absent (lock doors, close windows)
  • Comply with all HOA or community rules where applicable

Parking

  • Park only in designated areas
  • Maximum number of vehicles as specified per property
  • No recreational vehicles, trailers, or boats without prior approval

9. SURVEILLANCE AND SECURITY

Exterior Security Cameras

Some properties have exterior security cameras monitoring:

  • Driveways and parking areas
  • Entrances and exits
  • Outdoor common areas

NO cameras are placed in any interior spaces, bedrooms, or bathrooms. Camera locations are disclosed in property listings.

Property Access

We reserve the right to enter the property:

  • In emergency situations
  • For necessary repairs with reasonable notice
  • As required by law
  • If Terms violations are suspected

10. ASSUMPTION OF RISK AND LIABILITY

Recreational Activities

Properties may include amenities such as:

  • Hot tubs, pools, or water features
  • Fireplaces and fire pits
  • Decks and balconies
  • Grills and outdoor cooking equipment
  • Recreational equipment

Use of all amenities is at your own risk. Guests assume all responsibility for proper use and supervision of minors.

Limitation of Liability

To the maximum extent permitted by law, NC Cabin Rentals, LLC shall not be liable for:

  • Personal injury or property damage except where caused by gross negligence
  • Loss or damage to personal belongings
  • Interruption of utilities or amenities
  • Acts of God, force majeure, or circumstances beyond our control
  • Accuracy of property descriptions from third-party platforms

Insurance Recommendation

We strongly recommend guests obtain travel insurance and verify their personal insurance covers vacation rental stays.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless NC Cabin Rentals, LLC, its officers, directors, employees, agents, and property owners from any claims, damages, losses, liabilities, and expenses (including attorney fees) arising from:

  • Your use of the property
  • Violation of these Terms
  • Violation of any law or regulation
  • Injury to any person or damage to property
  • Any dispute between you and other guests

12. NORTH CAROLINA VACATION RENTAL ACT DISCLOSURES

As required by N.C. Gen. Stat. § 42A, we provide the following disclosures:

Mandatory Evacuations

In case of mandatory evacuation orders:

  • Guests must comply with all evacuation orders
  • Refunds will be processed per NC law requirements
  • We will assist with rebooking when possible

Property Conditions

  • Properties are provided in “as-is” condition except as specifically represented
  • Any known material defects are disclosed in property listings
  • Normal maintenance issues may arise and will be addressed promptly

Insurance Coverage

We maintain required insurance as mandated by North Carolina law.

13. DISPUTE RESOLUTION

Governing Law

These Terms are governed by the laws of North Carolina without regard to conflict of law provisions.

Dispute Process

  1. Direct Resolution: Contact us first at stays@nccabinrentals.com
  2. Mediation: If unresolved, parties agree to attempt mediation
  3. Legal Action: Must be brought in the courts of Watauga County, North Carolina

14. INTELLECTUAL PROPERTY

Website Content

All content on our website, including text, graphics, logos, images, and software, is the property of NC Cabin Rentals, LLC or our licensors and is protected by copyright and trademark laws.

Guest Reviews and Content

By submitting reviews, photos, or other content, you grant us a non-exclusive, royalty-free, perpetual license to use such content for marketing purposes.

15. THIRD-PARTY SERVICES AND LINKS

Booking Platforms

When booking through third-party platforms (Airbnb, VRBO, Booking.com), additional terms and conditions of those platforms apply.

External Links

Our website may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

16. ACCESSIBILITY

We strive to provide accurate information about accessibility features of our properties. Guests with specific accessibility needs should contact us directly to ensure properties meet their requirements.

17. FORCE MAJEURE

We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Government actions or regulations
  • Pandemic or epidemic
  • War or terrorism
  • Utility failures
  • Labor disputes

18. MODIFICATIONS TO TERMS

Right to Modify

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to our website.

Existing Reservations

Modifications do not apply to reservations confirmed prior to the change unless required by law.

19. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any property-specific rules, constitute the entire agreement between you and NC Cabin Rentals, LLC regarding your use of our services and rental of our properties.

21. SPECIAL PROVISIONS FOR PEAK SEASONS

During peak seasons (including but not limited to holidays and special events):

  • Minimum stay requirements may apply
  • Premium rates may be in effect
  • Stricter cancellation policies may apply
  • Advance booking requirements may be enforced

22. PET POLICY

For properties that allow pets:

  • Prior approval required
  • Additional fees apply
  • Maximum number and size restrictions apply
  • Guests are responsible for all pet-related damages
  • Pets must be supervised at all times
  • Evidence of current vaccinations may be required

23. SMOKING POLICY

All properties are strictly non-smoking. This includes:

  • Cigarettes, cigars, and pipes
  • E-cigarettes and vaping devices
  • Marijuana and other substances

Violation results in minimum $500 cleaning fee and possible eviction.
